The BCA’s reporting system allows you to report in a fast and secure way any conduct or practice that may infringe the rules applicable in Belgium for the protection of economic competition (cf. Book IV of the Economic Law Code, Articles 101 and 102 of the Treaty on the Functioning of the European Union, EU Regulation 139/2004 on the control of concentrations between undertakings, etc.). From experience, the assistance of people “in the field” with particular experience or expertise, including within the companies concerned, can be very helpful in enabling the BCA to detect competition problems (such as price or bidding agreements, or exclusionary practices by dominant companies) and thus protect effectively both economic actors and consumers.
If necessary, the BCA’s reporting system gives you the possibility to report an issue anonymously. For this reason, it is hosted by a specialised operator who offers this service to various competition authorities in Europe (including the European Commission). However, revealing your identity may increase the evidentiary value of the information provided and facilitate the BCA's investigation. In any event, even if you are willing to reveal your identity, the BCA is bound by a statutory obligation to protect the confidentiality of business secrets and other sensitive information provided to it.
The BCA’s reporting system complies with the provisions of EU Directive 1937/2019 on the protection of whistleblowers and EU Regulation 2016/679 on data protection.
If you have been personally involved in a cartel or if you are authorised to represent a company involved in a cartel, you can also apply for leniency in order to obtain an exemption from or a reduction of fine.
